This privacy policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it. For the purpose of the General Data Protection Regulation (“GDPR”), the data controller is Rich Benson Photography. The information and data you provide in connection with the provision of services of Rich Benson Photography, will be processed in accordance with the provisions of the GDPR.
We will comply with the GDPR which states that the personal data we hold about you must be:

- Collected only for valid purposes that we have clearly explained to you and not used in any way that is incompatible with those purposes.

WHAT DATA WE COLLECT
We will collect your name, postal address, email address and phone number. This is so we can communicate with you prior to, and on the date of the photography session, and to send you written communications and photographic prints.

Data is collected via a contact form on our website, or via email.
HOW LONG WE KEEP YOUR DATA
We will keep your information for as long as necessary in order to fulfil the service we are providing, and to comply with local laws, such as keeping tax records for 5 years.
WHERE WE STORE YOUR DATA
Your data will be stored on encrypted computer systems in the UK. Below you will see a list of partners, or service providers we use that may receive a copy of your data, who may operate outside of the UK/Europe:

SECURITY
All information is kept on secure systems, and is encrypted during sending and storage. Images may not be encrypted inside the Client Gallery.
COOKIES
We do not serve targeted adverts, but we may set unidentifiable tracking cookies to monitor visits to our website.
Mailing List
We will collect your name and email address for the purpose of sending you details of offers and free sessions. There is a link to unsubscribe within the email.
CLIENTS AND WEDDING GUESTS CAPTURED IN PHOTOS
Under GDPR legislation, a photograph may in some instances constitute a form of personal data where they can be processed to allow “the unique identification or authentication of a natural person”. We will never photograph an individual as a means of unique identification or authentication unless consensually contracted to do so. Guests at weddings appear in photos taken by us as a part of the visual recording of the event in photos. Guests captured in portraits or in group photos do so as part of the event and their rights are protected as detailed in this privacy policy.
In terms of explicit GDPR compliance, wedding clients and guests are photographed within the parameters of GDPR legislation on the basis of ‘legitimate interests’. The taking of photographs of wedding guests when viewed as a form of processing personal data is necessary for the legitimate interests of Rich Benson Photography as a photography business unless there is a good reason to protect a given individual’s personal data which overrides those legitimate interests.
Operating within the parameters of legitimate interests as laid out in GDPR legislation, the disproportionate effort involved in providing privacy policy information to all wedding guests at the event and the degree to which it would distract us from performing our job renders it infeasible to do so. Wedding clients are therefore requested in their contract to direct their guests to read this privacy policy in advance of the event and to advise them to contact us prior with any concerns around the processing of their personal data, namely being photographed.
DISPLAY OF IMAGES
We may display any photographs to promote Rich Benson Photography on our website and blog, on social media, on wedding blogs, on wedding photography related websites, in advertising, brochures, magazine articles and other such material, providing that the images used are used lawfully and without damage to our client(s). The rights of the people captured in these photographs are protected by Rich Benson Photography as detailed in this privacy policy.
RIGHT TO BE FORGOTTEN
You may request that your information is deleted by emailing hello@richbenson.com. We can only delete your data if we are no longer providing you with a service.
